1. Call to Order.

3. Approval of Minutes of the February 27, 2007 meeting.

4. Public comments on items not appearing on the agenda. (Maximum time allotted, 20 minutes with a limitation of 5 minutes per speaker).

5. Consideration of Two Resolutions:

The Public Hearings for the following two Resolutions were closed by action of the Planning Commission.

a. Consideration of a resolution approving a Conditional Use Permit to allow for the replacement of an existing wooden seawall with approximately 160 feet of new concrete seawall along the side of a human-made waterway; and an application for a Development Permit to implement the construction activity related to the replacement of the existing wooden seawall with a new concrete seawall, seawall cap, associated tiebacks and anchors. The subject property is located at 637 Lighthouse Way (Lot 41, Unit 4, Sanibel Estates; tax parcel no. 20-46-23-T2-01500.0410).  These applications are submitted for the property owners, John D. and Marlene Donaldson, by Timothy J. Murty, Esquire.

b. Consideration of a resolution denying an application for a variance to Land Development Code, Section 86-158. Minimum Size of Parcel to permit a three-unit multifamily (building) development to be established on a parcel of land that is less than the required minimum lot size of one (1) acre. The subject parcel of land (tax parcel no. 35-46-22-T1-00010.0110) is currently the site of the Riviera Restaurant located at 2761 West Gulf Drive. The application is submitted by the property owner, Island Wine and Dine Corporation. Application No. 06-3745V.ing) at 2761 West Gulf Drive.
