a. Construction of an erosion control structure at 2628 Coconut Drive, Resolution No. 08-03.
Consideration of a Resolution to approve applications to construct an erosion control structure at 2628 Coconut Drive submitted for a Conditional Use Permit for the placement of an accessory rip-rap structure (approximately 90 linear feet) for the shoreline protection of the waterfront property; and a Development Permit, to implement the installation of the erosion control structure, along the mean high water line of Dinkins Bayou (a natural body of water) that is adjacent to the subject parcel, as proposed by the conditional use permit application. The subject property (tax parcel no. 21-46-23-T1-00004.0160) is located on the east side of Coconut Drive. Both applications are submitted for the property owner, William Recker, by consulting engineer James H. Strothers, P.E. Application Nos. 08-4930DP and 08-4389CUP.

b. Replace an existing gravel driveway and parking area with brick pavers at 303 Periwinkle Way, Resolution No. 08-04
Consideration of a Resolution to deny an application to replace an existing gravel driveway and parking areas with brick pavers at 303 Periwinkle Way, consisting of an application for a Variance to Land Development Code Section 126-976 Applicability of regulations to parcels in more than one district (Ecological Zone) . . . , to permit the replacement of an existing gravel driveway and parking areas at Snug Harbor Condominium with 100% impervious brick pavers (approximately 21,500 square feet), which exceeds the maximum allowed impermeable coverage for the multiple ecological zones on the parcel, pursuant to LDC Section 126-976. The subject parcel is the Snug Harbor Condominium, located at 303 Periwinkle Way (tax parcel no. 21-46-23-T1-00800.00CE). The application is submitted by unit owner Thomas S. LaGuardia, PE, CCE, and Don Engen, Association President, on behalf of the Snug Harbor Condominium Association. Application No. 07-4297V.

c. Construction of an elevated swimming pool and deck at 4725 Rue Belle Mer and consideration of the outside professional review report regarding compliance with Land Development Code Section 86-43. Appearance of structures, size and mass of structures. Resolution 08-05.
Consideration of a Resolution approving an application for a Development Permit to construct an elevated swimming pool and deck at 4725 Rue Belle Mer. The proposed swimming pool and deck will be attached to the proposed single-family dwelling and elevated to a height higher than 7’ above predevelopment grade. Such development is required to be considered as a long-form application pursuant to Sanibel Code of Ordinances Part B, Land Development Code Chapter 126, Zoning, Article XIV, Supplementary District Regulations, Division 15, Elevated Swimming Pools.
Consideration of the outside professional review report regarding compliance with Land Development Code Section 86-43. Appearance of structures; size and mass of structures for the proposed single family dwelling and elevated pool located at 4725 Rue Belle Mer.
The subject property is located at 4725 Rue Belle Mer (tax parcel no. 19-46-22-T2-0060A.0020). The application is submitted on behalf of the property owners, David A. Mimms, by John Carsi, Palladian Design Studios. Application No. 07-4150DP.

9:15 A.M. 6. Commencement of scheduled public hearings:
a. An amendment to the Land Development Code revising procedures and standards for emergency electrical power generators.
Consideration of an ordinance amending the Code of Ordinances, Subpart A General Ordinances, Chapter 30 Environment, Article III Noise, Section 30-65 Exceptions, to make emergency electrical power generators exempt from the maximum permissible sound pressure levels; and amending Subpart B Land Development Code, Chapter 126 Zoning, Division 16 Emergency electrical power generators, Section 126-1306 Generally, to revise and add definitions and change procedures for permitting emergency electrical power generators; and amending Section 126-1306 Standards, to change sound pressure level standards for emergency electrical power generators; and adding a new Section 126-1307 Administration and enforcement; and amending Section 82-401 to add permanently installed emergency electrical power generators to the list of items eligible for a short form development permit; Providing for conflict and severance; Providing for codification; and Providing an effective date.

b. An Amendment to the Land Development Code requiring a long form permit application and review by the Planning Commission for all principal structures that include an integrally attached accessory structure that requires a long form permit.
Consideration of an ordinance amending the Sanibel Code, Part II Land Development Code: Chapter 82 Administration, Article IV Development Permits, Division 2 Procedure, Subdivision III Long Form, Section 82-421 Application, to require a long form permit application, and review by the Planning Commission, for all principal structures that include an integrally attached accessory structure that requires a long form permit; Providing for conflict and severance; Providing for codification; and Providing an effective date.

c. Discussion of revisions to Resolution No. 98-29, Article V which establishes the content and procedure for setting Planning Commission Agenda and Order of Business.
A Resolution of the Sanibel Planning Commission approving and adopting an amendment to the Rules of Procedure of the Planning Commission, Article V, “Agenda and Order of Business”, Section 5.01 Agenda, that will enable the Planning Commission to receive draft meeting Agendas from the Secretary and to recommend discussion items to the Secretary for inclusion as part of the final Agenda; recommending that City Council approve the amendments to the Rules of Procedure for the Planning Commission as set forth herein, as required by Article IX of such Rules of Procedure.

Review and discussion of City Council’s determination of the Planning Commission February 14, 2008 letter recommending that the Redevelopment Planning Work Program and Priorities be revised to enable the Commission to study and report on potential amendments to the Land Development Code that will address Appropriately Sized Houses and Neighborhood Rhythm and Harmony.
3. Review and discussion of potential amendments to Land Development Code, Chapter 126 Zoning, Article XIV Supplementary District Regulations, Division 3. Buildings and Area Requirements, Division 5.
